Law and ethics for behavioral health

This will be a six-hour web-based power-point presentation (6 CEs) that will focus on new laws, case law and regulations that will impact public entity healthcare providers or their patients and clients. Topics will include state and federal legislative updates, confidentiality, involuntary mental health holds, the CARE Act, social media and other ethical Issues.

Educational goals:
1. Among other things, after the training attendees will become familiar with legislative changes that directly impact their work as public entity healthcare professionals, or that may impact their clients, or that may impact their colleagues working in the healthcare field.
2. Attendees will be exposed to real life examples of ethical dilemmas and challenges in providing health care in public entity hospitals, clinics and programs, and gain an understanding of best approaches to resolve issues in their communities.

Learning objectives:

Explain three changes to CA minor consent laws that expand minors’ rights to seek and receive certain types of treatment based solely on their own consent
Identify two changes to CA laws related to authorization forms, and one change in Part 2 confidentiality laws that impact the release of protected health information to third parties
Identify which healthcare providers must post anti-trafficking posters in their facilities
List two changes in the LPS Act related to involuntary patients’ due process rights after a hold has been “written”
Discuss two ethical arguments that support voluntary care as being preferable for individuals who might be subject to the CARE Act
